Texas Tax Benefits Are Not Automatic

Start planning your move with a clearer understanding of the tax issues involved.

Moving to Texas doesn't automatically end your tax relationship with your former state. Texas has no state income tax and no return to file, which means the entire tax question lives with the state you're leaving. High-tax states actively review residency changes, and without the right planning and documentation, you could face continued tax exposure long after your move.

Before you relocate, it's important to understand:

Why your former state may still question your residency.
States like California and New York routinely audit departing high earners, and the burden of proving you left falls on you.

Why documentation matters.
There is no Texas "declaration of domicile" form. Your move is proven entirely through conduct, and the records you keep can determine the outcome if your residency is challenged.

Why timing can affect your tax exposure.
When you move, and what happens before and after, can significantly change what you owe. Bonuses, equity compensation, and deferred compensation can follow you across the state line.

Why your move should be coordinated before major income events or asset sales.
Sequencing a relocation around a business sale, IPO, or stock sale can meaningfully change the tax result. States scrutinize "move then sell" patterns.

Why Texas changes more than your income tax.
Community property rules, property tax deadlines, and homestead benefits all work differently here, and each affects your estate plan and your bottom line.
